Assuming its a lake and not some community creek... The DNR can ticket you for that, but it's unlikely since drunken flailing looks a lot like playful water antics from a distance.

Siedel182 you are correct. Not sure about the good ole U.S. but Most places in Canada you can get an ticket or minor offense for operating anything that puts your life at risk while under the influence.
if it doesn't have a motor which most kayaks don't you should be fine but you can get PC'd for public intoxication if you are kayaking on public property.
